Estos términos regulan el uso de la aplicación móvil d'Event (la «app»), que presta Property Atomic Strong SAC, RUC 20553703540, Perú («nosotros»). Al usar la app usted los acepta. Si no está de acuerdo, no la use.

1. Qué es d'Event

d'Event es una app para eventos. Quien organiza un evento (el «anfitrión») lo crea en la app y comparte un código de invitación; quienes lo reciben (los «invitados») entran con ese código y pueden, según lo que active el anfitrión, tomar fotos con una cámara desechable que se revela después del evento y dejar mensajes de voz.

2. Quién puede usarla

Debe tener 18 años o más. Los anfitriones inician sesión con Apple o con Google y son responsables de la actividad de su cuenta. Los invitados no necesitan cuenta: basta el código de invitación y un nombre.

3. Eventos y aprobación

Podemos revisar los eventos antes de activarlos y rechazar o desactivar los que incumplan estos términos. El anfitrión decide a quién invita, qué funciones activa y cuándo se revelan las fotos y los mensajes, e informa a sus invitados del uso de la app.

4. Su contenido

Las fotos, los mensajes de voz y los textos que usted sube («su contenido») siguen siendo suyos. Para prestar el servicio, nos concede una licencia no exclusiva, gratuita y mundial para guardar, procesar (por ejemplo, aplicar el revelado de la cámara y quitar la ubicación), mostrar su contenido a los participantes del evento y permitir su descarga por el anfitrión. La licencia termina cuando el contenido se borra, salvo copias ya descargadas por los participantes.

Usted garantiza que tiene derecho a subir su contenido y que no infringe derechos de terceros, incluida la imagen de las personas que aparecen.

5. Uso aceptable

No puede usar la app para:

• subir contenido ilegal, sexual explícito, violento, de odio, de acoso o que muestre a menores de forma inapropiada;
• suplantar a otra persona o usar un código de invitación que no le corresponde;
• atacar, sobrecargar, eludir la seguridad o hacer ingeniería inversa de la app o de nuestros servidores;
• recopilar datos de otros participantes para fines ajenos al evento.

Podemos retirar contenido y suspender o cerrar el acceso de quien incumpla estas reglas. Para denunciar contenido, escriba a contacto@proatomicdev.com.

6. Conservación y borrado

Las fotos, los mensajes de voz y los datos de invitados se borran automáticamente 90 días después del final del evento. El anfitrión es responsable de descargar antes lo que quiera conservar. Usted puede borrar sus datos o su cuenta en cualquier momento desde la app. Los detalles están en la política de privacidad.

7. Precio

Hoy la app es gratuita. Si en el futuro ofrecemos funciones de pago, sus condiciones se mostrarán antes de contratarlas.

8. Disponibilidad y garantías

Prestamos el servicio «tal cual» y «según disponibilidad». Hacemos lo razonable para que funcione y para proteger su contenido, pero no garantizamos que la app esté libre de errores o interrupciones ni que ningún contenido se pierda. Guarde copia de lo que sea importante para usted.

9. Responsabilidad

En la medida que lo permita la ley, no respondemos de daños indirectos, lucro cesante ni pérdida de datos, y nuestra responsabilidad total frente a usted se limita a lo que nos haya pagado en los doce meses anteriores al reclamo (o cero, si no ha pagado nada). Nada en estos términos limita la responsabilidad que la ley no permite limitar, ni sus derechos como consumidor.

10. Terminación

Puede dejar de usar la app y borrar su cuenta cuando quiera. Podemos suspender o cerrar cuentas que incumplan estos términos, o dejar de ofrecer la app avisando con antelación razonable cuando sea posible.

11. Cambios

Podemos actualizar estos términos. Cambiaremos la fecha de arriba y, si el cambio es importante, lo avisaremos en la app. Seguir usando la app después significa que acepta la nueva versión.

12. Ley aplicable

Estos términos se rigen por las leyes de la República del Perú. Cualquier controversia se someterá a los jueces y tribunales de Lima, Perú, sin perjuicio de los derechos que la ley de su país de residencia le reconozca como consumidor.

These terms govern your use of the d'Event mobile app (the "app"), provided by Property Atomic Strong SAC, RUC (Peruvian tax id) 20553703540, Peru ("we"). By using the app you accept them. If you do not agree, do not use it.

1. What d'Event is

d'Event is an app for events. Whoever organises an event (the "host") creates it in the app and shares an invitation code; those who receive it (the "guests") join with that code and, depending on what the host turns on, can take photos with a disposable camera that develops after the event and leave voice messages.

2. Who can use it

You must be 18 or over. Hosts sign in with Apple or Google and are responsible for the activity on their account. Guests need no account: an invitation code and a name are enough.

3. Events and approval

We may review events before they go live and reject or switch off any that break these terms. The host decides whom to invite, which features to turn on and when photos and messages are revealed, and tells their guests that the app is used.

4. Your content

The photos, voice messages and text you upload ("your content") remain yours. To provide the service, you grant us a non-exclusive, royalty-free, worldwide licence to store and process it (for example, to develop the camera's look and remove location data), to show it to the event's participants and to let the host download it. The licence ends when the content is deleted, except for copies participants have already downloaded.

You confirm that you have the right to upload your content and that it does not infringe anyone else's rights, including the image rights of the people in it.

5. Acceptable use

You may not use the app to:

• upload content that is illegal, sexually explicit, violent, hateful, harassing or that shows minors inappropriately;
• impersonate someone else or use an invitation code that is not meant for you;
• attack, overload, bypass the security of or reverse-engineer the app or our servers;
• collect other participants' data for purposes unrelated to the event.

We may remove content and suspend or end access for anyone who breaks these rules. To report content, write to contacto@proatomicdev.com.

6. Retention and deletion

Photos, voice messages and guest data are deleted automatically 90 days after the event ends. The host is responsible for downloading anything they want to keep before then. You can delete your data or your account at any time from the app. Details are in the privacy policy.

7. Price

The app is currently free. If we offer paid features in the future, their terms will be shown before you buy them.

8. Availability and warranties

We provide the service "as is" and "as available". We do what is reasonable to keep it working and to protect your content, but we do not guarantee that the app is free of errors or interruptions or that no content will ever be lost. Keep a copy of anything that matters to you.

9. Liability

To the extent the law allows, we are not liable for indirect damages, lost profits or loss of data, and our total liability to you is limited to what you paid us in the twelve months before the claim (or zero, if you paid nothing). Nothing in these terms limits liability that the law does not allow to be limited, or your rights as a consumer.

10. Termination

You can stop using the app and delete your account whenever you like. We may suspend or close accounts that break these terms, or stop offering the app with reasonable notice where possible.

11. Changes

We may update these terms. We will change the date above and, if the change is significant, tell you in the app. Continuing to use the app afterwards means you accept the new version.

12. Governing law

These terms are governed by the laws of the Republic of Peru. Any dispute will be submitted to the judges and courts of Lima, Peru, without prejudice to the rights the law of your country of residence gives you as a consumer.
